Vizaops AI — A Product of Hezekiah Consultancy

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Vizaops AI platform ("Platform"), operated by Hezekiah Consultancy ("Company," "we," "us," or "our"), accessible at vizaops.com.

By creating an account or using the Platform, you ("User," "you," or "your") agree to be bound by these Terms. If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not access or use the Platform.

2. Description of Service

Vizaops AI is a B2B SaaS platform designed to help travel agencies and corporate clients manage visa applications, track processing status, and streamline immigration-related workflows. The Platform provides tools for:

  • Visa application submission and tracking
  • Document management and organization
  • Client and applicant management
  • Processing status updates and notifications
  • Reporting and analytics

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice.

3. Account Registration

3.1 Eligibility

You must be at least 18 years of age and capable of entering into a legally binding agreement to use the Platform. The Platform is intended for business use by travel agencies, corporate HR departments, and immigration consultancies.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete registration information
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Not share your account with unauthorized individuals

We are not liable for any loss or damage arising from your failure to comply with these security obligations.

4. Subscription and Payment

4.1 Pricing

The Platform offers various subscription tiers with different features and pricing. Current pricing is available on our website. We reserve the right to change our pricing at any time, with reasonable notice provided to existing subscribers.

4.2 Payment Terms

When online payment processing becomes available on the Platform, the following terms will apply:

  • Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan
  • All fees are non-refundable unless otherwise stated or required by applicable law
  • You are responsible for all applicable taxes associated with your use of the Platform
  • Failure to make timely payments may result in suspension or termination of your account

4.3 Free Trial

We may offer free trial periods at our discretion. At the end of a free trial, your account may be converted to a paid subscription or access may be limited unless you select a paid plan.

5. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Platform for any illegal or unauthorized purpose
  • Upload or transmit any malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to the Platform, other accounts, or related systems
  • Interfere with or disrupt the Platform or servers connected to it
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Use the Platform to process fraudulent visa applications or forged documents
  • Resell, sublicense, or redistribute access to the Platform without our written consent
  • Scrape, crawl, or use automated means to extract data from the Platform
  • Violate any applicable local, national, or international law or regulation

6. Intellectual Property

6.1 Our Intellectual Property

The Platform, including its software, design, text, graphics, logos, and all related intellectual property, is owned by Hezekiah Consultancy and protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Platform beyond the limited right to use it in accordance with these Terms.

6.2 Your Content

You retain ownership of any data, documents, or content you upload to the Platform ("User Content"). By uploading User Content, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Platform services to you.

You represent and warrant that you have all necessary rights to upload and use any User Content on the Platform and that such content does not infringe upon the rights of any third party.

7. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

You acknowledge that the Platform may process sensitive personal data (such as passport details and travel information) on behalf of your clients. You are responsible for ensuring that you have obtained all necessary consents from your clients before uploading their data to the Platform.

8. Service Availability and Uptime

We strive to maintain high availability of the Platform but do not guarantee uninterrupted or error-free service. The Platform may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Unscheduled maintenance or emergency repairs
  • Factors beyond our reasonable control, including internet outages, natural disasters, or third-party service failures

We shall not be liable for any loss or damage resulting from service interruptions or downtime.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the Platform will meet your specific requirements, that results obtained from using the Platform will be accurate or reliable, or that defects will be corrected.
  • In no event shall Hezekiah Consultancy, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
  • Our total liability to you for any claims arising from or related to these Terms or the Platform shall not exceed the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Hezekiah Consultancy, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any applicable law or the rights of any third party
  • Any User Content you upload to the Platform

11. Termination

11.1 Termination by You

You may cancel your account at any time by contacting us at support@vizaops.com. Upon cancellation, your access to the Platform will be terminated at the end of your current billing period.

11.2 Termination by Us

We may suspend or terminate your access to the Platform immediately, without prior notice or liability, if:

  • You breach any provision of these Terms
  • Your use of the Platform poses a security risk or may adversely affect other users
  • We are required to do so by law
  • We decide to discontinue the Platform or any part thereof

11.3 Effect of Termination

Upon termination, your right to use the Platform will immediately cease. We may retain your data for a reasonable period to comply with legal obligations. You may request export of your data within 30 days of termination by contacting support@vizaops.com.

12. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Platform shall be resolved as follows:

  • Informal Resolution: Before initiating any formal proceedings, both parties agree to attempt to resolve any dispute informally by contacting the other party and negotiating in good faith for a period of at least 30 days.
  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions.
  • Jurisdiction: Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Islamabad, Pakistan, and the parties consent to the personal jurisdiction of such courts.

13. General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Hezekiah Consultancy regarding the Platform and supersede all prior agreements and understandings.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
  • Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet outages, or pandemics.
  • Notices: All notices to us should be sent to support@vizaops.com. We may send notices to the email address associated with your account.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the Effective Date. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.
